At his Manhattan appearance on the morning of Wednesday, Daniel Penny, a 24-year-old former U.S. Marine accused of killing Jordan Neely, entered a plea of not guilty.
Penny is a Hero
It took Penny roughly five minutes to enter a not-guilty plea against the allegations of second-degree killing and criminally negligent murder. Penny was dressed in a dark blue suit.
He was given the identical $100,000 bail terms that got him out of jail before.
Neely, a 30-year-old homeless guy with a track record of assaulting train passengers and a long criminal background, was mentally ill. After a chaotic confrontation on a subway car for the F train, eyewitnesses claim he threatened passengers.
Penny stepped in to protect them.

He was choked by Penny, who then used another straphanger to drag him to the ground. An additional traveler managed to record a portion of the altercation.
Daniel Penny is charged with manslaughter after purportedly keeping Jordan Neely in a fatal chokehold until the time he ceased to move, according to Manhattan District Attorney Alvin Bragg.
“As they keep continuing to grieve the terrible loss, I hope Neely’s family members are moving toward reconciliation.”

The choice of whether or not to charge Penny has drawn criticism for being politically motivated, but supporters of the veteran contend he behaved in self-defense or in the interest of other travelers.
In June, Penny said to Fox News Digital that if Neely followed through on his threats, he would’ve murdered someone on that train.
Self-Defense
When an irate Neely entered the subway at the Second Avenue station in Manhattan around 2:30 p.m. on May 1, Penny claimed he was on his way to the gymnasium. Neely was yelling at commuters and panhandling.
As reported by another rider, Neely yelled that he’ll murder a f*** if he has to. “I’ll take a bullet, I’ll go to jail.”
