Stefanik also pointed out that Judge Engoron entered summary judgment against the defendant before the trial even began, without witnesses, evidence, or cross-examination, despite disputed material evidence. Although the defendant had repaid the Wall Street banks involved, with interest, as agreed, and no insurance company had lost any money, the judge proceeded to hold a trial, without a jury, to determine damages.
